The rules state that in PvP the winner can keep the items if he/she feels like keeping them. Before you enter every PvP area there are multiple signs that warn you about this fact.
I think it would be a bit of an overreaction and a waste of your VIP to not return, but this is of course your own decision.

Also, Caps are really not necessary..
